Smoking Restrictions

New York State Clean Indoor Air Act (CIAA)


The New York State CIAA limits smoking in indoor places of employment. This includes all bars and restaurants. The amendment to the Act became effective on July 22, 2003. Enforcement is conducted via complaint investigation and as an adjunct to any other EH program activity conducted by staff. Environmental Health partners with the Tobacco Coalition to conduct periodic sweeps of all liquor license facilities to verify compliance with the law.

Tobacco Control


The Adolescent Tobacco-Use Prevention Act (ATUPA) conducts compliance checks on all facilities that sell tobacco products to ensure that tobacco is not sold to youths. The State law became effective on September 6, 1992. There are approximately 44 tobacco retailers.
