RECOGNITION
The Clerk read the Recognition of Roberta Fuller(Area Agency on Aging/Nutrition) on the occasion of her retirement as cook/manager of the Cincinnatus/Willet Senior Centers and Chairman Harrington thanked her for the years of dedicated service. Mr. Law told everyone how much Roberta Fuller would be missed at the Center.

RESOLUTION OF THE LEGISLATURE OF THE COUNTY OF CORTLAND,
PROVIDING AN EXEMPTION FROM SALES AND COMPENSATING USE TAXES
FOR RECEIPTS FROM RETAIL SALES OF, AND CONSIDERATION GIVEN OR CONTRACTED TO BE GIVEN FOR, CERTAIN CLOTHING AND FOOTWEAR, PURSUANT TO THE AUTHORITY OF ARTICLE 29 OF THE TAX LAW OF THE STATE OF NEW YORK.
BE IT ENACTED, by the Legislature of the County of Cortland, as follows:
SECTION 1. Section six of Resolution No. 216 of 1967, as amended, is amended by adding a new subdivision (h) to read as follows:
(h) Receipts from sales of and consideration given or contracted to be given for
purchases of clothing and footwear exempt from state sales and compensating use taxes pursuant to paragraph (30) of subdivision (a) of section 1115 of the New York State Tax Law shall also be exempt from sales and compensating use taxes imposed by this resolution.
SECTION 2. This resolution shall take effect March 1, 2001, and shall apply to sales made and uses occurring on or after that date although made or occurring under a prior contract.
SECTION 3. This resolution shall expire on February 28, 2002 unless otherwise extended or reenacted by the Cortland County Legislature with appropriate approval of the State of New York.
Mrs. Price explained that New York State is two years late with the reporting of sales tax revenue to the counties, so it is not possible to have an accurate picture of the impact of the removal of sales tax. Mrs. Contento said she would vote against the resolution until she saw the dollar impact on the budget. Mr. O'Mara said that the sales tax revenue is up, even with the estimated $350k loss and he thought that people were spending the money in different ways. Mr. Wern suggested the legislators talk to the merchants who are seeing an increase in shoppers from outside the area. Mrs. Price added that now we also had to look at the impact of possible removal of energy sales tax.

WHEREAS, Excellus, the Rochester-based company that operates BlueCross BlueShield health plans based in Rochester, Syracuse and Utica; and Univera Healthcare, the Syracuse and Buffalo-based health maintenance organizations, have merged into a singe not-for-profit insurer, AND
WHEREAS, Univera is requesting that the Cortland County Health Department Division of Nursing sign a formal contract for each line of business for each Univera region, and
WHEREAS, this would allow the Cortland County Health Department to better serve the people in the community in need of these services, NOW, THEREFORE, BE IT

Ms. Jackie Gailor, Director of Health, said the legislators have always been very supportive of the health programs in Cortland County. She said $45k has been spent towards prevention in Cortland County, with the primary emphasis focused on youth to make the decision against tobacco use. Mr. Boise said it was wise to emphasize prevention; he objected to money being used for a sting operation, as was the case in Agenda No. 48. Mr. Forbes commented that public statements are made about the harmful effects of smoking and then institutions such as the Cortland Memorial Hospital and Cortland County provide facilities for their employees to smoke. Mrs. Richards agreed with Mr. Forbes and said the only hope was in prevention. Mr. Thomas brought up the subject of the bookcovers that were discussed during the public hearing. He said there was nothing wrong with the covers since they conveyed the 'don't smoke' message. Mr. Harrington added that, statistically, the largest age group of new smokers was the 19-22 year old college student. He said the message is out there and it needs to be reinforced particularly for the young adults.

WHEREAS, bids for a "Breathing Air Compressor" were received and publicly opened and read on December 8, 2000, BE IT HEREBY
RESOLVED, that, in accordance with the recommendation of the Judiciary & Public Safety Committee, the County of Cortland accepts the bid for a Breathing Air Compressor and Cascade System from Tyler Fire Equipment, Elmira, NY 14925, the lowest responsible bidder.
Mr. Plew asked where the Breathing Air Compressor was stored. Mr. Tanner, Director of Fire & Emergency Management, said it would continue to be stored at the City of Cortland Fire Department. Mr. Forbes asked if it was necessary to have more then one in the County? Mr. Tanner said the present County unit was twenty-five years old and that Cortlandville had been gracious in allowing them to use their equipment as a back up. The new air compressor would shorten fill time and the County would continue to use Cortlandville as a back up.

WHEREAS, the County, acting through its Personnel/Civil Service Office is required to give certain agility tests to Police Officer and Correction Officer candidates, and such other County employees as may require agility testing for their position with the County, AND
WHEREAS, the YMCA has personnel skilled in the area of expertise required to give and score such examination, NOW, THEREFORE, BE IT
RESOLVED, that the County of Cortland enter into an agreement with the YMCA whereby the YMCA will perform agility tests of designated County employees who require such tests for their employment. The term of this agreement shall be from January 1, 2001, through December 31, 2001. The consideration to be paid to the YMCA shall be nine dollars ($9.00) per person tests, but no less than twenty-seven dollars ($27.00) per occurrence.
