WHEREAS, Governor Pataki endorses the Institute and New York State hosts the Institute in collaboration with partner states of New Hampshire, New Jersey, Pennsylvania, Maine, Rhode Island and Vermont, AND
WHEREAS, the Cortland County Health Department has available funds in the budget to pay $325.00 plus mileage for the 3-day travel agenda to West Greenwich, Rhode Island, NOW, THEREFORE, BE IT

RESOLVED, that the Public Health Director be and hereby is authorized to sign a two year contract between the Health Department and Jack Venesky for Medicare and Medicaid cost report software and consultation for a fee of $18,390 and $5,040 respectively payable January (Medicare portion) and May (Medicaid portion) of 2001 and 2002, after review and approval of the contracts by the County Attorney.

WHEREAS, the Cortland County Health Department has again been awarded a grant by Health Research, Inc in the amount of $10,042 for the Breast and Cervical Cancer Early Detection Program (9/30/00 – 9/29/01) which will pay for mammograms and pap smears for uninsured and underinsured women, AND
WHEREAS, these funds are in the 2000 budget, NOW, THEREFORE, BE IT
RESOLVED, that upon review and approval of the County Attorney, the Cortland County Health Department enter into this agreement with Health Research Inc. to receive these funds.
Mr. Forbes questioned how the public was made aware of the program. M.J. Uttech, Deputy Public Health Director, said there was a coalition of health care providers and they were all aware of the program and made referrals. She said there were also advertising campaigns to make the working poor aware of the availability of the services. Mr. Forbes asked if all the funds were expended and M.J. Uttech said she was unsure of the answer.

WHEREAS, Marni Christopher, an RPN in the Health Department – Nursing Division has been out of work since June 8, 2000, AND
WHEREAS, Mrs. Christopher has exhausted all available leave time, the twelve (12) weeks of Family/Medical Leave which expired August 31, 2000, and a thirty (30) day leave of absence from the Department head expired on September 30, 2000, AND
WHEREAS, the employee is not yet able to return to work, NOW, THEREFORE, BE IT

NYS CHILD HEALTH PLUS AND MEDICAID FACILITATED ENROLLMENT
WHEREAS, Resolution #129-00 gave the Health Dept. approval to enter into an agreement and accept funds of $46,000 from the NYS Health Dept. for the period 11/1/99 through 10/31/00 to create a network of community-based providers to assure children access to high quality health care through enrollment in the appropriate health coverage programs, AND
WHEREAS, this resolution also gave the Health Dept. as lead agency approval to contract with community agencies to help coordinate the efforts of this grant, AND
WHEREAS, NYS would like to extend the term of the original agreement for an additional year through 10/31/01 and to add the option to renew for two additional one year periods. NOW, THEREFORE, BE IT

WHEREAS, On March 11, 1992 the County of Cortland entered into a two year extendable License Agreement for the exclusive right to operate the concession's at Dwyer Memorial Park with the CINDY'S CATERING of Homer, New York, and
WHEREAS, said agreement states that Licensee may at the expiration of the first year of the term and at the expiration of each annual period thereafter elect to extend for an additional period of one year, the exclusive right to operate the Concession at Dwyer Memorial County Park Pavilion, shelters and grounds, and
WHEREAS, Cindy's Catering has again submitted a letter wishing to extend for the additional year which extends the expiration date through the year 2002, and
WHEREAS, it would be in the best interest of Cortland County to extend the agreement for an additional on year period, NOW, THEREFORE, BE IT
RESOLVED, that the Legislature of the County of Cortland hereby authorizes such extension of the said Concessions Agreement for a period of one year, to expire on December 31, 2002.

WHEREAS, as in the past years, there is a need for two (2) temporary positions to administer this program, AND
WHEREAS, these positions are funded entirely by federal dollars, NOW THEREFORE, BE IT
RESOLVED, that the following full-time temporary positions under §64 of Civil Service Law be and hereby are created with permission to fill for the HEAP program for the 2000-2001 season: two Community Services Workers (Gr. 4 $18-375-$20,445 competitive class) for the period commencing November 13, 2000, for the duration of the HEAP season not to exceed May 11, 2001, AND BE IT FURTHER

Mrs. Price asked if the senior keyboard position was vacant at this time? Mr. Boise said it was and this was just an upgrade. Mr. Hugh Hurlbut, Director of Personnel/Civil Service, added that indeed the position was vacant and that this was a promotion for the person taking the position. Mrs. Contento said that the Buildings & Grounds Committee sent a letter to the Department of Social Services expressing their dissatisfaction with the scheduled elimination of the listing of the Information Center phone number in the local telephone book. She said it was unfair to the public and was a continuation of the trend to all voice mail. Mr. Boise said she should also mention that more individual numbers would be listed. Mr. VanDee added this was a Building & Grounds issue.

WHEREAS, there was no money originally budgeted for ATI in the year 2000 to purchase equipment, NOW, THEREFORE, BE IT
RESOLVED, that the revenue in the ATI fees (bail refund account) A315142.41515 be increased by $1,113.00 and that the Office Equipment account A31515.52010 also be increased by $1,100.00 in order to purchase a new computer for ATI through Data Processing.

CORTLAND COUNTY E-MAIL USE POLICY
WHEREAS, it has been deemed necessary that the procedure and policy pertaining E-mail use in County departments that was adopted by RESOLUTION NO. 338 on October 8th, 1997, be clarified and revised,
NOW, THEREFORE BE IT,
RESOLVED, that the following revised policy entitled "e-mail Use Policy" be adopted by the Cortland County Legislature, to be effective immediately.
Purpose and Goals
E-mail is one of Cortland County’s core internal and external communication methods. The purpose of this policy is to ensure that e-mail systems used by agency staff support agency business functions to their fullest capacity. This policy advises staff and management of their responsibilities and provides guidance in managing information communicated by e-mail.
Access to E-mail Services
E-mail services are provided to staff subject to authorization by appropriate management and compliance with county policies and procedures. The county reserves the right to remove a user account from the e-mail system.
Use of E-Mail
E-mail services, like other means of communication, are to be used to support agency business. Staff may use e-mail to communicate informally with others in the agency so long as the communication meets professional standards of conduct. Staff may use e-mail to communicate outside of the agency when such communications are related to legitimate business activities and are within their job assignments or responsibilities. Staff will not use e-mail for illegal, disruptive, unethical or unprofessional activities, or for personal gain, or for any purpose that would jeopardize the legitimate interests of the State.
Privacy and Access
E-mail messages are not personal and private. E-mail system administrators will not routinely monitor individual staff member's e-mail and will take reasonable precautions to protect the privacy of e-mail. However, program managers and technical staff may access an employee's e-mail:
for a legitimate business purpose (e.g., the need to access information when an employee is absent for an extended period of time);
to diagnose and resolve technical problems involving system hardware, software, or communications; and/or
to investigate possible misuse of e-mail when a reasonable suspicion of abuse exists or in conjunction with an approved investigation.
A staff member is prohibited from accessing another user's e-mail without his or her permission.
E-mail messages sent or received in conjunction with agency business may:
be releasable to the public under the Freedom of Information Law;
require special measures to comply with the Personal Privacy Protection Law.
All e-mail messages including personal communications may be subject to discovery proceedings in legal actions.
Virus Hazards
E-mail is the #1 means of spreading and receiving computer viruses. Certain precautions must be made to limit the vulnerability of County computers and data from being infected by viruses.
All computers with e-mail access must have a Data Processing approved Anti-virus software installed and updated at least monthly.
Security
E-mail security is a joint responsibility of agency technical staff and e-mail users. Users must take all reasonable precautions, including safeguarding and changing passwords, to prevent the use of the account by unauthorized individuals.
Management and Retention of E-mail Communications
Applicable to all e-mail messages and attachments
Since e-mail is a communications system, messages should not be retained for extended periods of time. Users should remove all e-mail communications in a timely fashion. If a user needs to retain information in an e-mail message for an extended period, he or she should transfer it from the e-mail system to an appropriate electronic or other filing system. E-mail administrators are authorized to remove any information retained in an e-mail system that is more than 60 days old.
Applicable to records communicated via e-mail
E-mail created in the normal course of official business and retained as evidence of official policies, actions, decisions or transactions are records subject to records management requirements under the Arts and Cultural Affairs Law and specific program requirements.
Examples of messages sent by e-mail that typically are records include:
policies and directives,
correspondence or memoranda related to official business,
work schedules and assignments,
agendas and minutes of meetings,
drafts of documents that are circulated for comment or approval,
any document that initiates, authorizes, or completes a business transaction,
final reports or recommendations.
Some examples of messages that typically do not constitute records are:
personal messages and announcements,
copies or extracts of documents distributed for convenience or reference,
phone message slips,
announcements of social events.
Record Retention
Records communicated using e-mail need to be identified, managed, protected, and retained as long as they are needed to meet operational, legal, audit, research or other requirements. Records needed to support program functions should be retained, managed, and accessible in existing filing system outside the e-mail system in accordance with the appropriate program unit's standard practices.
Records communicated via e-mail will be disposed of within the record keeping system in which they have been filed in accordance with a Records Disposition Authorization (RDA) approved by State Archives and Records Administration (SARA). Program managers should consult with the Agency Records Management Officer concerning RDAs applicable to their program's records.
Users should:
dispose of copies of records in e-mail after they have been filed in a record keeping system;
delete records of transitory or little value that are not normally retained in record keeping systems as evidence of agency activity.
Roles and Responsibilities
County executive management will insure that policies are implemented by departmental heads and unit supervisors. Department Heads and unit supervisors will develop and/or publicize record keeping practices in their area of responsibility including the routing, format, and filing of records communicated via e-mail. They will train staff in appropriate use and be responsible for ensuring the security of physical devices, passwords, and proper usage.
County network administrators are responsible for e-mail security, backup, and disaster recovery.
All e-mail users should:
Be courteous and follow accepted standards of etiquette.
Protect others' privacy and confidentiality.
Consider organizational access before sending, filing, or destroying e-mail messages.
Protect their passwords.
Remove personal messages, transient records, and reference copies in a timely manner.
Comply with agency and unit policies, procedures, and standards.
Policy Review and Update
County Data Processing will periodically review and update this policy as new technologies and organizational changes are planned and implemented. Questions concerning this policy should be directed to Data Processing.
Mr. VanDee voiced his concern that not everyone was aware of the changes. Chairman Harrington said all legislators were supplied with copies of the policy that established ground rules and explicit parameters.

WHEREAS, Central Services is in need of a new copy machine to properly serve Cortland County AND
WHEREAS, the lowest quotation was received from Danka, NOW THEREFORE BE IT
RESOLVED, that upon signing of the contract by the County Attorney or his designee, the Personnel Officer is authorized to purchase a Kodak 95 photocopier from Danka at a cost of $5,017 which is the total cost for a two-year lease with purchase at the end of two years, and BE IT FURTHER
RESOLVED, that the Personnel Officer is authorized to purchase a service contract for the above-referenced photocopier at an annual cost of $1,944.
Mr. Wern made the point that all departments should be made aware of the new equipment and the improved capacity and capability. Mrs. Brown said she thought it was too much money and questioned the cost of buying the equipment outright and the expense of the service contract. Mr. Hugh Hurlbut, Director of Personnel/Civil Service, said the service contract covered everything except the paper and the County could purchase the copier for $1.00 after two years. Mr. Hurlbut said this was the most economical of the five proposals that were presented. He said the machine could be purchased outright for $4,400. Mrs. Brown offered a friendly amendment that would eliminate the last resolve (Resolved, that the Personnel Officer is authorized to purchase a service contract for the above-referenced photocopier at an annual cost of $1,944.) and was seconded by Mr. Thomas. Mr. Forbes suggested that the equipment be purchased outright. Before a vote, Mr. Hurlbut suggested to Mr. Dwyer that the item be tabled until he (Mr. Hurlbut) could gather all the information that was being requested. All motions were withdrawn and Agenda No. 15 was tabled until the next session.

SETTING COMPENSATION
SOIL & WATER CONSERVATION DISTRICT BOARD
WHEREAS, Section 7 of the Soil and Water Conservation District Law authorizes a County Legislature to authorize payment of per diem compensation and mileage in going and returning from official business for their appointees on a Soil and Water Conservation District Board, AND
WHEREAS, such compensation is contingent on funds being provided by the County Legislature for this purpose, AND
WHEREAS, this Legislature wishes to compensate its appointees to said Board for their service to the County, AND
WHEREAS, the appointees to the Soil and Water Conservation District Board have been receiving $15.00 per diem compensation as set by this Legislature on July 10th, 1996, NOW, THEREFORE, BE IT
RESOLVED, that the per diem compensation of this Legislature’s appointees to said Board be and hereby is set at $25.00, AND, BE IT FURTHER
RESOLVED, that the Legislature’s appointees to said Board be and hereby are authorized to continue receiving mileage at the general County rate for travel necessary to said Board’s business.
Mrs. Contento said she would vote no because they needed to consider all the other boards and the ultimate expense to the County. Mr. O’Mara said it was mandated that this board receives a stipend. He said their meeting were frequent and long and were very demanding. Mr. Thomas said we ask these people to serve and they need to be compensated in some small way. Ms. Amanda Barber, Director of the Soil and Water Conservation District, said the law provides for the stipend and there were only three people involved for an approximate cost to the county of $360 - $500 per year. She added that these were people that the legislature had asked to serve. Chairman asked if the law said "allowed or provided for a Stipend"? He also asked if anyone remembers when and how the Board came under the umbrella of the County Legislature. He said it is a quasi department. Mr. Law said a local law had set up the Soil & Water Conservation District Board as a separate agency.

RECYCLING ATTENDANT
WHEREAS, there is frequent turnover in the Recycling Attendant (PT) positions in the Solid Waste/Recycling Department, AND
WHEREAS, the Solid Waste/Finance and Administration Committees recommend that the positions be filled upon vacancy, NOW THEREFORE, BE IT
RESOLVED, that the Cortland County Legislature hereby approves the filling of the Recycling Attendant (PT) positions, $8.50/hr, Labor Class, as they occur, on or after October 11, 2000, AND BE IT FURTHER
RESOLVED, that the Cortland County Treasurer is hereby authorized and directed to pay the persons holding the positions of Recycling Attendant (PT) in biweekly installments.
Mr. Forbes said he thought it was law that all vacancies had to come to the legislature to be filled. Mr. VanDee said this is a part time position and both the Highway and Sheriff’s Department fill their part time positions without coming to the legislature. Mr. O’Mara reminded everyone of the high turnover in this position. Mr. Law agreed with Mr. Forbes that it was policy for all jobs to come before the legislature to be filled. Mrs. Brown suggested that it should be decided on a department by department basis. Mr. VanDee agreed and said it would help the departments, particularly the small one, if they could fill these positions immediately, rather than waiting for the next legislative session. RESOLVED, that the County Treasurer be and hereby is authorized to pay the incumbent in weekly installments in accordance with the County Management Compensation Salary Plan.
Chairman Harrington declared a recess at 10:52 a.m. The legislative session resumed at 11:02 a.m. On the motion of Mrs. Richards, seconded by Mrs. Brown and adopted, all members present voting aye, the Legislature went into Executive Session to discuss pending litigation. On the motion of Mr. Teeter, seconded by Mr. Boise and adopted, all members present voting aye, Executive session ended at 11:10 a.m.
