DRAFT MINUTES

Present:                      Dan Tagliente, Vice Chairman; John Daniels, Tom Hartnett, John Steger and Newell Willcox

Others present:          Marilyn Brown, Chairman, Cortland County Legislature; Scott Schrader, County Administrator; Katrina Spicer, Secretary to County Administration; Richard Van Donsel, County Attorney; Brian Parker, Superintendent of Buildings and Grounds; Tim Smith, Deputy Superintendent of Buildings and Grounds, Jim Shear, Diekow Electric; Eric Mulvihill, WXHC; and Corey Preston, Cortland Standard;

Absent:                       Kay Breed, Steve Dafoe and John Steger

Mr. Tagliente called the meeting to order at 7:26 a.m.

Mr. Tagliente expressed that the meeting had been called to discuss the resolution, Award Bid for Purchase and Installation of Emergency Generator for County Office Building that was approved on June 12, 2007 by the Committee.  He explained plans to issue change orders immediately in regards to the original bid specifications.  Mr. Tagliente recommended that the Committee reject the bids received and re-bid the project with the new specifications.  Committee members discussed the difference in price between the low bid and the price as a result of the change order.  They further discussed the generator and the structure to house it.  Mr. Daniels inquired as to the correct process in which to accomplish this.  Chairman Brown and Mr. Tagliente expressed that the bids received need to be rejected.  Mr. Schrader cautioned the Committee that by doing this they might give the lowest bidder a reason to challenge the bid process.  Mr. Van Donsel pointed out that the bids could be rejected for no reason.  Mr. Schrader also expressed that the bids may be negotiated without giving reason also.  He expressed that negotiating the bid is what was being done.  Mr. Schrader expressed that a resolution needs to be drafted to reject the bids and forwarded to full Legislature for their approval.  He expressed that the reason for rejection is that the low bid exceed the appropriated fund for the project.  Mr. Tagliente made a motion to pull Award Bid for Purchase and Installation of Emergency Generator for County Office Building resolution formerly approved by the General Services Committee on June 12, 2007 and to direct Mr. Schrader to draft a resolution to reject the bids stating the reason being that the low bid exceeded the funds appropriated for the project; seconded by Mr. Daniels.  All members present voting in favor; none opposed; motion carried.  

Mr. Tagliente adjourned the meeting at 7:30 a.m.
